Rental Agreement

WEDDING ARCHIVES - EQUIPMENT RENTAL AGREEMENT

This Equipment Rental Agreement (“Agreement”) is entered into by and between Wedding Archives (“Lessor,” “we,” “us,” or “our”) and the individual or entity placing an order for rental services (“Lessee,” “you,” or “your”).

This Agreement becomes effective upon your electronic acceptance, signature, or purchase of services. By placing an order, you agree to be bound by this Agreement, whether or not you have read it.

Wedding Archives reserves the right to update or modify this Agreement at any time. Updated terms apply immediately upon posting.

1. Purpose
Wedding Archives provides do-it-yourself wedding video rental services. Lessee is renting video recording equipment for use during a wedding or related event. All physical items provided are referred to as the “Equipment.”

2. Services & Equipment Rental
The specific Equipment and services provided are those listed on your invoice, order confirmation, or checkout receipt.

Wedding Archives may refuse any rental at its discretion. If an order is declined prior to shipment, all payments will be refunded in full.

3. Rental Term
The rental period begins on the first attempted delivery date by the shipping carrier and ends 72 hours after the wedding date.

We aim to deliver Equipment at least 48 hours before your wedding, typically 4–6 days prior. Delivery dates are not guaranteed due to carrier limitations.

Equipment must be shipped back using the provided return label and dropped off before the carrier’s cutoff time on the final rental day, unless otherwise approved in writing. Late returns may result in additional charges.

You authorize Wedding Archives to contact you via email, phone, text, or mail regarding your rental.

4. Payment
All rental fees are due in full before shipment.

Unless otherwise stated, all payments are non-refundable, except as outlined in Section 10 (“Video Guarantee”).

5. Use of Equipment
You agree to:

Use the Equipment carefully and responsibly
Follow all provided instructions and manufacturer guidelines
Comply with all applicable laws
Not modify, repair, or disassemble the Equipment
You are responsible for anyone who uses the Equipment while it is in your possession.

6. Condition of Equipment
Equipment may be previously used and may show cosmetic wear. Wedding Archives guarantees that Equipment will be functional at the time of shipment.

Any issues must be reported immediately upon receipt. Do not attempt to fix or troubleshoot damaged Equipment yourself.

7. No Warranties
Except as expressly stated, Equipment is rented “as is.”
Wedding Archives makes no guarantees regarding fitness for a particular purpose, uninterrupted operation, or recording results.

We are not responsible for:

User error
Missed recordings
Improper setup
Environmental or electrical interference
Artistic dissatisfaction

8. Loss, Damage & Responsibility
You assume full responsibility for the Equipment from delivery through return.

If Equipment is damaged, lost, stolen, or returned excessively dirty, Wedding Archives may charge:

Repair costs (up to $700)
Replacement cost if beyond repair
Loss-of-use fees
Cleaning fees
Damage or loss does not relieve you of payment obligations.

9. Return & Inspection
Returned Equipment will be inspected within a reasonable time. Acceptance of returned Equipment does not waive our right to assess damage or fees.

10. Video Guarantee
A refund may be issued if no usable video is obtained due solely to:

Equipment malfunction not caused by user error
Shipment lost in transit
Equipment failing despite proper setup and use

Refunds are not available for:

Failure to return Equipment
Cancellations or change of plans
User error
Failure to follow instructions
Damage during rental
External or environmental interference

11. Intellectual Property
Any edited content or materials created by Wedding Archives remain our intellectual property.

You are granted a non-exclusive, personal-use license to share your video for personal purposes with credit to Wedding Archives.

Commercial use is not permitted without written permission.

12. Cancellations & No-Shows
Cancellations, reschedules, or event changes do not entitle you to a refund unless approved in writing.

If Wedding Archives is unable to perform due to circumstances within our control, we will notify you and issue a refund proportional to services not provided.

13. Indemnification & Liability
You agree to indemnify and hold harmless Wedding Archives from any claims, damages, or expenses arising from your use or possession of the Equipment.

Our total liability under this Agreement shall not exceed the amount paid for your rental.

14. Force Majeure
Wedding Archives is not liable for delays or failures caused by events beyond our control, including natural disasters, pandemics, carrier delays, or supply disruptions.

15. General Terms

Age Requirement: Renters must be at least 18 years old
Assignment: This Agreement may not be transferred without written consent
Entire Agreement: This Agreement supersedes all prior discussions
Severability: Invalid provisions do not affect remaining terms
Amendments: Must be in writing

16. Governing Law

This Agreement shall be governed by the laws of the State of Kansas.
Venue for any legal action shall lie in the courts of the State of Kansas.
